Privacy and data use policy
At YB Consultancy · Yani Borrell we take your privacy seriously. This policy explains what personal data we collect through this website and our contact channels (including instant messaging), what we use it for, who we share it with and what rights you have. Last updated: October 27, 2026.
01Data controller
The controller of your data is Yanisei de la Caridad Borrell Ojeda, NIE Z4514475V, with address at Calle Ortega y Gasset 66, La Navata, Galapagar, Madrid 28420 (Spain), trading as YB Consultancy · Yani Borrell (“we”), an immigration advisor. You can reach us at info@yani-borrell.com or by phone and WhatsApp at +34 686 520 445. We process data in accordance with Regulation (EU) 2016/679 (GDPR), Spanish Organic Law 3/2018 and, where applicable, the privacy laws of the place where you live.
02Data we collect
Depending on how you interact with us, we may process: (a) identification and contact details (name, email address, phone and WhatsApp number); (b) the content of your messages, enquiries and forms; (c) data needed to book an appointment (name, contact details, date and time, reason for the consultation); (d) if you hire our services, the information and documents you provide for your procedure (which may include identity data, immigration status, family details and other information); (e) if you take part in our job opportunities campaign, your résumé and the data it contains (experience, education, languages, country of residence and availability); and (f) technical browsing data, in aggregate form and without cookies (see “Analytics and cookies”).
03Purposes and legal basis
We use your data to: answer your enquiries and requests (basis: your consent or pre-contractual measures at your request); manage and provide the services you hire, including communication about your case (basis: performance of the contract); manage appointments and reminders (basis: performance of the contract or pre-contractual measures); receive and review your résumé if you take part in our job opportunities campaign (basis: your consent); comply with legal, tax and accounting obligations (basis: legal obligation); keep the site secure and measure its performance (basis: legitimate interest); and, only if you expressly agree, send you news or information about our services (basis: consent, which you may withdraw at any time). We do not make decisions based solely on automated processing that produce legal effects on you. We classify your enquiries internally by topic and urgency only so we can handle them faster.
04Instant messaging (WhatsApp and similar)
We offer WhatsApp as a quick contact channel at +34 686 520 445, and we may also assist you through Facebook Messenger, Instagram or other messaging apps if you write to us through them first. By contacting us through instant messaging, or by clicking the WhatsApp buttons on this site, you accept the following:
Starting and scope. The WhatsApp buttons on the site only open the app with a pre-filled message that you can edit; nothing is sent until you send it. When you write to us, we process your phone number, profile name, the content of the conversation and any files you attach in order to handle your enquiry and, if you are a client, to manage your case.
Service communications. If you are a client or have requested an appointment, we may message you to confirm or remind you of appointments, request documents, update you on the status of your procedure or answer questions. We may use WhatsApp Business, including its API, through technology providers acting on our behalf. We will not send you promotional messages or bulk communications without your prior, express and revocable consent.
Opting out. You can stop receiving messages at any time by replying “STOP” (or “BAJA”) or by writing to info@yani-borrell.com. If you do, we will only contact you through that channel when it is essential for your case or required by law.
App provider. WhatsApp belongs to Meta Platforms and other apps have their own providers. They process your data (for example, number, usage and device metadata) as independent controllers under their own terms and privacy policies, over which we have no control. WhatsApp messages are transmitted encrypted, but we cannot guarantee the security of your device or of the app’s backups.
Sensitive information and documents. For your safety, we recommend that you do not send passwords, access codes or full bank card details by chat. Personal documents (passports, background checks, certificates, etc.) should only be sent when we ask for them and through the means we indicate; we may ask you to use a more secure channel. We may store the conversation and the files received in the client file when they are needed for the procedure.
Verification and third parties. We may ask for details to verify your identity before discussing your case. Do not add third parties to the conversation or share other people’s data without their authorization. Conversations are confidential and are not used for purposes other than those described in this policy.05Message management and artificial intelligence
To handle your messages quickly we use a message management platform hosted on Amazon Web Services servers in the European Union (Spain) and administered by our technology provider Bit Data LLC, which acts as a processor on our behalf. It centralizes the messages received through WhatsApp, Facebook Messenger and Instagram.
To help us draft replies we may use artificial intelligence tools that suggest a draft. Every draft is reviewed by a member of our team before it is sent, and we do not make decisions about you based solely on automated processing. The content of the conversation needed to draft the reply is sent to these tools; the tool provider acts as a processor, which may involve transfers outside the European Economic Area (see “International transfers”). You may ask at any time to have your enquiry handled by a person by writing to info@yani-borrell.com.06Résumés and job opportunities campaign
If you send us your résumé, we receive it free of charge to include it in our initial profile review. We process the résumé and the contact details you provide to assess your profile and to contact you if an opportunity arises or we need further information (basis: your consent, which you may withdraw at any time). Receiving your résumé is not a job offer and does not guarantee employment, a visa or any authorization.
We will not share your résumé with employers or other third parties without your prior consent. Please do not include in your résumé, or send by chat, a copy of your passport, criminal record, medical documents or bank details. If you send us someone else’s résumé, you must have their authorization.
We keep résumés for as long as they are needed for this purpose. You may ask for them to be deleted at any time by writing to info@yani-borrell.com (see “Data deletion”).07Contact form and email
The data in the contact form (name, email, subject and message) is sent encrypted to a service in our Amazon Web Services account in the European Union (Ireland region), which forwards it by email to our info@yani-borrell.com inbox, hosted on Zoho Mail. We only use it to reply to you. The form includes simple anti-spam measures that do not identify the user. Email sent directly to our address is processed for the same purpose.
08Booking appointments
The “Book an appointment” buttons take you to our booking platform (sgc.bitdatallc.com), run by our technology provider, where you will be asked for the details needed to book and manage your appointment. That provider processes the data on our behalf and only for that purpose.
09Analytics and cookies
This site does not use cookies or store persistent identifiers in your browser, so a cookie banner is not required. We measure site usage with Amazon CloudWatch RUM configured without cookies, to learn about pages visited, performance, technical errors and clicks on contact buttons (appointment, WhatsApp, phone, email, form). This is technical, aggregated data that we use to improve the site; we do not use it to identify you or for advertising. If we add tools that use cookies in the future, we will tell you and ask for your consent where the law requires it. Fonts and images are served from the site itself, with no external font services.
10Recipients and providers
We do not sell your data. We only share it with providers that supply services we need and act on our behalf (hosting and email delivery on Amazon Web Services, email on Zoho, the booking and management platform, a message management platform, artificial intelligence tools and business messaging providers), and with authorities, administrations, courts or professionals when required by law or when you ask us to file or process documents with them. We require them to maintain confidentiality and appropriate security measures.
11International transfers
Our services are provided from the European Union. Some providers (for example, messaging apps, email, our technology provider or artificial intelligence tools) may process data outside the European Economic Area, including the USA. In those cases we require appropriate safeguards, such as the EU-US Data Privacy Framework or the European Commission’s standard contractual clauses.
12Retention
We keep your data only for as long as necessary for the purpose for which it was collected. Enquiries with no follow-up are deleted once they are no longer needed to answer them. Client data is kept for the duration of the relationship and afterwards for the applicable limitation and legal retention periods (tax, accounting and liability), after which it is deleted or anonymized. If you withdraw your consent, we will stop processing the data for that purpose.
13Data deletion
You may request deletion of your personal data at any time, including your WhatsApp, Facebook Messenger and Instagram conversations, by writing to info@yani-borrell.com and stating the channel and the name or number you used to contact us. We will delete your data from the messaging platform and our systems, except what we must keep because of a legal obligation. Backups are deleted automatically within a maximum of 30 days. We will confirm the deletion by the same means.
14Security
We apply reasonable technical and organizational measures to protect your data: encrypted connection (HTTPS), encrypted form communications, restricted access to information and providers that meet recognized security standards. No system is infallible; if a breach affecting your rights occurs, we will notify you and report it to the competent authority in the cases and within the deadlines required by law.
15Your rights
You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw your consent at any time (without affecting the lawfulness of prior processing), by writing to info@yani-borrell.com stating your request. We may ask you to prove your identity. We will reply within the legal deadline (one month, extendable in complex cases). If you believe we have not processed your data properly, you may lodge a complaint with the Spanish Data Protection Agency (aepd.es) or with the supervisory authority of your country. If you live in the USA, you may request access to or deletion of your data under your state’s law through the same channel.
16Minors and third-party data
This site and our services are not aimed at children under 14 and we do not knowingly collect their data without the authorization of a parent or guardian. If you give us data about family members or other people for a procedure, you declare that you have their authorization or the necessary authority to do so.
17Third-party links
This site links to social networks (Instagram, Facebook, TikTok), to WhatsApp and to the booking platform. Once you access them, your data is governed by those third parties’ privacy policies, which we recommend you read.
18Changes
We may update this policy to reflect legal changes or changes in our services. We will publish the current version on this page with its update date; if the change is significant, we will let you know by an appropriate means.
19Contact
For any question about this policy or about how your data is processed, write to us at info@yani-borrell.com or on WhatsApp at +34 686 520 445.
By using this website, sending us a message or hiring our services, you confirm that you have read and understood this Privacy Policy.
